Litigation |
| PakGlobal has on
its strength experienced lawyers well versed in IP litigation. The
litigation includes civil and Criminal Litigation. Usually civil action
against the violator of infringement and passing off gets initiated
in the District Court, which has the original civil jurisdiction to
try the IP matters. The remedies include suit for infringement, passing
off, perpetual / mandatory injunctions, rendition of accounts and
damages. On the criminal side the criminal action can begin by the
registration of case with the concerned Police station for offences
provided under the various IP laws and under the Pakistan Penal code.
The other method is to lodge a criminal complaint (private complaint)
with the magistrate in whose territorial jurisdiction the offence
is committed. |
